Legal Question in Civil Litigation in Michigan

default on settlement agreement

In a settlement agreement the city agreed to a perform a task by a certain date, which the city failed to do. The court issued a notice of no progress and the court dismissed the city's case against me.

My lawsuit against the city remains active.

I received paperwork from the city attorney saying that the attorny's have reached an agreement an I need to sign the papers and dismiss my case. I had no knowledge of this agreement and did not consent to it. The papers deal with issues regarding the charges made by the city whose case was dismissed and does not deal with my charges against the city.

Do I have to sign papers which state a settlement for a case that was dismissed by the court over a month ago?

Re: default on settlement agreement

I assume that you have no lawyer. Parties can agre to things without the case being active. However, you provide no details so I cannot give accurate answers. Bill Stern
