Legal Question in Landlord & Tenant Law in Michigan

I would like to evict my habitually late paying tenant. I have served the 7 day pay or quit notice for this month(Michigan). I want her out even if she pays during the eviction. Can I still evict even after I receive payment or must I give an additional 30 day notice to vacate. This is a month to month tenacy agreement. I want her out because every month she waits until she gets the eviction notice and then pays, dismissing the court hearing every time, costing me time and money every month. I would like to get her out without giving her an additional free months ride. Is this possible??

It is very simple. You send her the notice with termination of tenancy language. Her paying won't matter, because the tenancy is over. If you need legal help with this, contact me at kliszlaw.com
