How long are you able to take legal action after a family member has died of a medical mistake?

It depends upon whether or not the person was a minor and what year the person died. Due to tort reform, the statute of limitations in medical malpractice cases has become a complex issue and I don't have enough information to answer you question. The statute of limitations is two years after the letters of authority for the deceased person are issued. The important thing is to see a competent lawyer who specializes in medical issues right away. Try to get the relatives involved and appoint one person to be in charge.
