Legal Question in Real Estate Law in Michigan

what happens to the proceeds from property sold after someone in a nursing home

If someone is in a nursing home on medicaid and passes away, then there house is sold, can the state take any or all of the proceeds from the sale of the house to reimburse the state medicaid? Or once they pass away and the house is sold does the family keep the proceeds?

Re: what happens to the proceeds from property sold after someone in a nursing h

As I understand it, one would have to divest(sell) his/her home in order to qualify for medicaid in the first place. That is, unless they have a living spouse, then I believe medicaid will allow them to keep the residence for the spouse. Otherwise, I believe one needs to be indigent to get medicaid. How this person received medicaid without selling the house, I don't understand. For more info., please contact my office at (248)851-3171.
