Legal Question in Real Estate Law in Michigan

Real Estate Disclsure info

We sold our home of 6 yrs approx. 2 weeks ago. We disclosed that there was a grading issue that was rectified in 2002 by ourselves, therefore, we have no paperwork. We just received a call saying the basement was leaking due to the grading issue. We have not had ONE issue with leaks in the basement since we rectified the grading problem. What course of action should be taken? Please advise!

The first document I would want to see as a real estate attorney is the Seller�s Disclosure to indicate how you answered the questions about leaks and the basement as well as disclosing the grading.

The other thing I would consider from a practical issue is did the buyers have a home inspection, and if so are there any note of concerns or lack of concern. During our most recent downpour, were all the downspouts and elbows in place to move water as intended away from the foundation? Then, try to find out why the buyers were calling and what it is they are seeking from you. By any chance did the buyers lose power so that the sump failed and water was able to come in that way?

As someone who actively worked as a Realtor prior to turning to real estate law the above items I have seen as well as reasons for a recent re-occurrence of the leak.
