I have a question. My husband and I bought our house in September of 2005. When we looked at the house we intented to buy we took our five kids with us. My husband and I overlooked many wrong this with the house such as rough flooring, old appliances left behind, and little things such as that. When looking in the basement we saw a sumpump. We asked if the basement leaked and we were told no, not at all. So we read over our paper work before we submitted our offer. The sellers disclosure said, no flooding, no esbestos, no lead paint. We thought well can't hurt a few new windows, some rug, new appliances and we'll be alright. So we bought the house. Now 75% of our house is not insulated and we called a company to put insulation into our walls and they sent out an inspector. Let me tell yuo, this house has loads of lead paint, esbestos in our basement and the foundation is crumbling due to over 10 years of flooding. What leagal rights do I have? If I would have known all this I would not have put my 5 kids in this house. Please someone help me. My baby girl has juvinelle arthritis and she suffers all the time. The inspector guy for the insulation said it could be because of the swamp we live on. Please please help me.

If it can be proven that the conditions were present and undisclosed when you bought the house, you likely have a good breach of contract action against the prior owners, and possibly against anyone who performed an inspection and failed to disclose or discover these defects. You have to have proof that these conditions actually exist in your house - and if have the flooding you say you do, you likely have mold also. You need to contact a lawyer and get a full home inspection - you may have to vacate if the home is rendered unsafe to live in.
