Legal Question in Real Estate Law in Michigan

Request and Order to Seize Property

I have a judgement against an individual in small claims court for $3,000. The person failed to appear in court, so the judgement came in my favor. I have a question on filling out the form (Request and Order to Seize Property), I would like to place on Lien on a piece of property that the defendant owns, and the property is currently for sale. How do I get this form filled out properly?

What information do I put on this form so I can get attached as a crediter for this property?

Thanks

Re: Request and Order to Seize Property

The form you refer to is used for execution, but under Michigan law you must first attempt to execute against personal property before you are allowed to go after real property. Execution can be an involved process and not produce the best results, especially against an individual, non-business debtor. There are other methods by which you may attempt to collect.
