Legal Question in Real Estate Law in Michigan

Ex won't sign quit-claim on house

Two years ago, our divorce judgement assigned the house to me, and my retirement account balance to my ex. Altho' he's received his cash from the account, he won't sign a quit-claim on my house. I've refinanced it under my name alone, based on the divorce judgement. Will his refusal to sign affect my ability to sell the house? If so, how can I get a court to force him to sign?

Re: Ex won't sign quit-claim on house

If your divorce judgment was entered in court, in settlement of a divorce action, you can file an action to enforce the judgment in which your ex-husband agreed to assign the house to you. A call by an attorney to your husband indicating that a suit will be filed may do the trick. Otherwise, you would now file in the court where the divorce judgment was entered.
