Legal Question in Wills and Trusts in Michigan

My Aunt passed away two years ago, leaving equal portions of her financial institution's assets to my Mother, my brother, and me. My brother never responded to my phone calls or letters and has not yet retrieved his portion, as one of the beneficiaries. Can I obtain a court order to remove him as beneficiary and split those assets with my Mother, or give them to his children?

There is a lost property department in the State of Michigan. You should contact that department if the funds are not in a financial institution. If the money is at a financial institution, they have a procedure to transfer the funds to the State. I have never heard of skipping a beneficiary unless he is deemed incompetent or dead.
