Legal Question in Wills and Trusts in Michigan

Deceased mother was included in grandfathers will- transfer to me?

My mother passed away before my grandfather but apparently was still included in his will. Does her inheritance trickle down to my brother and I? Were we supposed to be notified of the will, and how do we obtain a copy of the will?- her brothers and sister have apparently kept it a secret from us. I only found out because my uncle is trying to buy my grandfather's house but needs a copy of my mother's death certificate because she was named as an heir to the estate.

Your stake in your grandfather's estate depends on the language of the will. You may likely have a claim to the estate. If a probate estate has been opened in the proper county, and the will admitted, it is now a matter of public record and you would have access to it at the court. If you run into problems getting information from the other relatives, you may wish to consult an attorney. Please contact me at (248) 305-5840 with any questions.

If your mother predeceased your grandfather, then her devise(part of the will) will fail. Unless, the will specifically provides for her children to receive in her stead. You need to see the will. For more info, please contact my office at (248)851-3171.
