You would need to open a probate file, become appointed personal representative and then execute a new deed. If you would like assistance in the matter, please contact me via my website at www.lawrefs.com.

If the deed is "with full rights of survivorship" you only need to record the deed with the county register of deeds office to remove the decedant's name from the title to the property. If the deed is does not have the language quoted above, her share must be desposed of by the probate procedure. If you want the sons names off or you want to cash out your share, there is a different procedure. Please contact me to disucuss in detail at johntatone.com
