Legal Question in Wills and Trusts in Michigan

My mother's estranged husband passed away in 2007. His brother took it upon the duties of executor of estate. In all of the documents he filed, he somehow managed to never mention my mother, or her children, and subsequently took ownership over the full estate. He falsified documents by stating he was of caucasian decent, when he was in fact asian. There was no mention of the time he served in the military. Even went as far as to say he had never been married. My question is, what can we do, how might we proceed, and if an attorney is necessary, are there any who might do cases pro bono or by contingency?

Other relevant factors include-

We live in Washington State. My mother and step-father have been married about 35 yrs, separated for all but the first 3 yrs, yet he refused to divorce my mother. He never remarried or had any children of his own.
