power of attorney - Guardianship

If an individual is incapacitated due to health reasons, may a family member gain a power of attorney and guardianship if not of stable mind and body? This individual is fine now and would like the POA and guardianship removed and a new POA established. A sister did this and did not have full consent from the individual
