Legal Question in Wills and Trusts in Michigan

quit claim deed fraud

my husbands mom was coerced into signing her house over to her son. Mom has alzheimers and dementia. Day after she signed her house over she was put in a nursing home. Long sad story. Question is do any of the 6 siblings have an recourse?

Re: quit claim deed fraud

It sounds as though she would not have been competent to sign the deed and so it should be voidable. Moreover, unless great care was taken to document the situation, the transfer of the house will be regarded as a divestment which will prevent her from receiving medicaid assistance with the cost of her long term care. If the facts are as you describe and more or less a situation of abuse, there would be tremendous leverage for having the transfer reversed.
