Legal Question in Wills and Trusts in Michigan

Truck ownership transfer

My brother has a truck that is paid off. This and some furniture are his only assets. How do I make sure that they don't go through probate once he is deceased? Do I need a will? Trust? Notarized document?

Re: Truck ownership transfer

A will would not keep the truck out of probate court, though your brother would specifically be able to give it (via the will) to anyone he wishes. A trust would keep his assets out of probate but would be expensive and inefficient considering the size/quantity of his assets. Your brother could also keep the truck out of his probate estate if he legally transfers it to someone while he is alive. If you should have further questions, please contact me at www.lawgreg.com
