Legal Question in Bankruptcy in Minnesota

i have been divorced 3 years now. the house and 2nd loan on the windows, along with credit card debt was awarded to her in court. i have had no luck getting my name off the loans or the credit cards because they were issued in both of our names. i just tried to get prequalified for a home loan and it turns out she is making the house payment after she had the loan modified, but is still behind on it. she makes speratic payments on the window loan and hasn't touched the credit cards debt. it is killing my credit. the relitor i talked to said bring her back to court and have the judge force her to get rid of the house. i doubt that would happen in court. so i am wondering if i were to file bankruptcy on the house, window loan, and credit card debt, that would free me and my credit from the negitive marks but then i would have a bankruptcy on there. is it true that it is possible to get a home loan 2 years after filing?

I would have to examine your divorce decree carefully to accurately answer this question. It seems that this house is headed for foreclosure. When that is over with, any second mortgage on the home will likely seek payment from you.

As far as getting a home loan, I am not a loan officer. The criteria for home loans is probably a proprietary process. Most of my clients find their credit improves after the file bankruptcy and begin paying their bills on time again.
