Legal Question in Credit and Debt Law in Minnesota

If I am receiving a letter from a collection agency, not my original credit card company, do they have the right to sue me for the money?

The answer depends on a few things: Does the collection agency have a right to collect the debt? In other words has the collection agency been assigned the account or purchased it from from the original credit card company? Can they prove they have a valid assignment or purchase? Has the statute of limitations expired on the original account? My suggestion would be to contact a consumer attorney who is familiar with the Fair Debt Collection Practices Act. Our firm focuses on this area of practice and we would be more than happy to provide you with a free consultation. Feel free to give us a call at 952-314-1400.
