Legal Question in Criminal Law in Minnesota

My ex has 6 misdemeanors, 4 gross misdemeanors and 1 felony. 5 of those misdemeanors were assaults. 3 of which were domestics. He has been arrested again for domestic assault. It has been nearly 5 years since his last assault. What are the sentencing guidelines and most likely outcome of this?

He could be looking at a new felony and should consult someone who has trial experience in this area call us to discuss the facts. Do not give a statement to anyone. Talk to a lawyer first. 763 421-1441

Hello. Your fiance should confer with an attorney at this time. The full facts need to be known. The matter is obviously serious. Computing sentencing likely would be complex but your fiance is only charged at this time, not convicted. If two of those are actual prior domestic convictions within the last 10 years, he will be looking at a felony domestic assault here. From there, sentencing can vary greatly. Much depends on his criminal history score and the severity of the incident. With that said, the discussion should not jump directly to sentencing. He first must be convicted of the offense, and he should have an experienced criminal defense attorney challenge the evidence against him. I prosecuted domestic violence cases for seven years and would be happy to do a free consultation.
