Legal Question in Criminal Law in Minnesota

3 yrs ago my son got in trouble, he was given 5 yrs probation for assult. 2 years later he violated prob by leaving state and is trying to rectify this and they have pushed his court date repeatedly for the past 6 months, how do you get any results? No one returns calls from the PD office. His original offense was strictly a mishap and not his fault. All he wants to do is leave the state and finish his probation in Illinios, he is currently homeless and can live with his brother in Ilinois.

Thank you for the post.

First, your son must arrange with the probation office and/or the Department of Corrections to transfer any probation to that state. The State of Minnesota will agree so long as there is no cost to the State of Minnesota. That means your son will be required to pay a fee for that probation.

Secvond, your son can still be violated and receive any part of the jail sentance previously stayed. If he plead guilty, he is deemed guilty and describing the incident as a mishap would not mitgate the circumstances,
