Assault 2-substantial injury-no weapon-unk /

After throwing a large drinking glass at a waitress� head in a bar, My friend was arrested and is being held in Jail pending charges of second- degree assault. The victim was found to have swelling on her forehead and a laceration which required stitches . He is going to court tomorrow. Please advice on what he next step will be and is it advisable for him to retain an attorney before making the appearance? How do we go about bail? What's the punishment for such a crime given its the first offense? Thank you

A second degre assault is a very serious felony and may result in jail time if convicted. As a result, your friend would be very wise to hire an attorney. There are many defenses. However, those defenses would depend on the particular facts of the case.

A bail hearing considers the nature of the offense, the ties thatthe person has to the community, past record and other issues related to the threat the person possesses to the community and the likelihood that they will return to court for their appearances.
