I made a horrible decision of pawning my moms ring from her ex husband, i got 800 dollars, (the ring was worth much more) the ring was recovered and returned to her. Also i pawned a bracelet of hers and that was not recovered. My mom has since forgiven me, but the police got involved. Now im waitng to hear from the district attorney. WIll I get a felony? im am so scared please tell me as much as you can and any advice.

Ultimately, the decision whether to proceed is up to the prosecuting attorney and not your mother. Your mother, however, may be able to convince the prosecuting attorney to drop the charges. In most cases, the prosecution is not going drop the charges based on the plea of the victim, but since it is your mother there is a chance. You and your mother should both consult with attorneys before speaking to the prosecution. Something you or your mother say could make things worse. If you haven't heard from the prosecutor, maybe you are in the clear.

Thank you for the email.

A theft offense can be very serious. While any theft between $500 but less than $1000 is a gross misdemeanor. Such an offense is still punishable by up to 1 year in jail and a $3000 fine. The collateral consequences of a conviction can also be extremely significant and preclude a person from finding employment where background checks are performed.

Often, if you have no prior offenses, a conviction can be avoided with a Stay of Prosecution. A Stay of Prosecution means that the offense is never recorded on your record and stayed for a certain period of time to ensure that you do not have another offense.

We can assist you in making sure that your record is not affected.
