car accident

thank you for your time- my sister was driving my 99 caviler on feb.16.07 she had 2 passengers in the car. she came to a stop sign stopped ,looked both ways,proceeded and was hit, broadsided on passengers side. 2 car came from an alley way and made no attempts to stop,ie slamming on the breaks,swerveing,etc. no injuries either car so far. she got a failure to stop ticket and 2nd driver had insurance but no mn. D.L. just one from mexico.he denies she stopped at stop sign. she says she did and both passengers state she did. car is totaled his car is smashed too.found out my insurance had lapsed and at the time of accident . I'm the owner of the car and did have insurance on it just libilitybut it had lapsed. I've never really had any driving problems so I dont know what to do or go about it .I need help thank you very much

I think you will be stuck with a no insurance violation.

As far as the failure to stop ticket, you daughter should take the ticket to court, get a trial on the ticket, and present witnesses (her passengers).

There is the possibility that the other motorist sues you for damages, but the first step in preventing a law suit is to fight the stop sign ticket. Good Luck.
