Re: Intent to Sell Question

You can be charged with intent to sell or distribute a contolled substance based on the quantity of the substance in your possession, or based on the possession of tools or materials commonly used for the packaging and distribution of the drugs (if there are other facts that suggest an intent to distribute), and certainly if you confess to distributing the substance. Under the facts you have described, it is certainly possible you could be charged.

If you are charged, you may yet have a number of defenses. First, there may be an issue about the manner in which evidence, including a confession or statement, was obtained by the police. If the search was illegal, or you were the subject of a custodial interrogation and were not first given a Miranda warning, some of the evidence against you may be inadmissible. More facts are required to evaluate those issues. If you are charged you should contact an attorney and, depending on your income, may qualify for a PD.

You may contact me if you have further questions or concerns about this matter. My contact information is below.

And one last thing, if you are approached by the police, or arrested, do not under any circumstances make statements about the case, the pot, the scales, or your intentions, to the police or a prosecutor.

Good luck.
