Legal Question in Criminal Law in Minnesota

Question: "A woman filed and was granted an exaggerated restraining order against me stating that I followed her home, that I call and text her and etc. She's obsessed with my husband and I've heard him tell her to stop calling me. Now I did respond to her in a very unpleasant because I told her not to text and call my phone. I saved everything including a snap shot of her # on my caller id. I got served today on 1/5/2015 texted my phone again after she was granted a restraining order on 12/26/14 BUT SHE TEXTED MY PHONE AGAIN ON 1/2/15 AGAIN claiming my husband was with her that morning when he was next to me. Obviously she violated her own restraining order. It cost too much to much to file a claim back so what can I do due to her violation."

A restraining order governs the conduct of the respondent to the action, not the protected party. I suggest you confer privately with an experienced attorney at this time so she can assist you. Perhaps you yourself ought to initiate protective action. Some attorneys, not all, will provide reduced fee for financial hardship. There is a way to request a reduction or even waiver of the court filing fee.
