Legal Question in DUI Law in Minnesota

Minors

I was at a party and the cops came into the house with a warrant. They gave everyone breathelizers and i blew a .10 and the cop gave me a ticket for minor consumption. The cop didnt write down my blood alcohol level on the ticket or did he say how much it was going to be. Told me to call a number. Can i get out of this ticket since they dont know what i blew or what should i do?

Re: Minors

It is not necessary that the ticket indicate the blood alcohol level. However, there are other challenges to your charge that seem likely.

If the officer simply began asking all those present at the party to provide a breath sample, that request may be challenged as an unlawful search since the necessary indicia giving rise to a reasonable suspicion that a crime has been committed is absent.
