underage drink and drivew

My17 year old was stopped for speeding and etoh breathilizer read .023. Thus charged underage drink/drive as well. It was 08am. My teen denies drinking the night before. But did take a drink out of a bottle of opened coke in the refridgerator ( possible had etoh in it) prior to driving home. We await court date. What would be the best way to proceed. What are likely penalties?

The offense is a misdemeanor and punishable by up to 90 days in jail and a $1000 fine. Additionally, on a first offense, the juvenile's license may be revoked for 30 to 90 days.

High risk insurance cost for five years, an alcohol-related driving incident on the drivers license record, criminal court probation for a year or two, etc. - unless he fight the "implied consent" drivers license revocation by filing a challenge within 30 days, and avoid a guilty plea or conviction on an alcohol-related criminal charge. The best way to proceed is to retain a good DWI defense lawyer (like me) ASAP, and fight it all.
