How do you get a child support order overturned in minnesota and is there a statute?

If you are wondering how to modify a child support order, you may want to review the forms you can find at www.mncourts.gov. Child support is based on the gross income of both parents, the number of children and non-joint children, and the percentage of parenting time. Before child support can be modified, the new child support amount must be a change of more than 20% and a change of at least $75.

The question is whether you are seeking to modify an existing order or seeking to appeal an order recently entered.

If you are seeking a modification, you must file a Motion to modify which must be supported by a substantial change in circumstance since the last order was entered. It is presumed that a substantial change has occurred if the application of child support guidelines results in a 20% change in the obligation and at least $75 per month.

If you are seeking to appeal a recently entered court order, you must seek a review of the Magistrate's order by a Magistrate or District Court Judge ad/or appeal to the Court or Appeals where the appeal must be filed within sixty (60) days from the Notice entry of the Order.
