Legal Question in Family Law in Minnesota

I am going to divorice my husband, we have three minor children. He has been telling me that he can use two year old wages to set child support, he just has to find the right attorney. I told him the law states there is to be no reason for anything other than current wages to be used. He told me wait and see if you hire an attorney and go ahead with throwing me out.

Thank you for your question. You should remember that talk is cheap. The law can look at an obligor's historical earnings, depending on the circumstances, but in general child support is determined based on his current income. You clearly should contact a lawyer. You may contact me if you have additional questions.
