Legal Question in Family Law in Minnesota

Joint custody with child support

I have joint legal custody with my ex-husband. There is no effort on his part to help pay for his children. My current husband and I pay for everything (school supplies, clothing, field trips, school lunches etc. ) I have made the effort of talking to him to receive some type of assistance but nothing ever happens. With having joint legal custody of our children, how do I get him to pay some type of support to us ?

Response:

"Legal" custody is a completely separate issue from support. All it means is he has a right to be consulted about major events in the child's life, such as elective medical procedures; it has nothing to do with his support obligation.

I suggest going to the support and collections office in the county where you reside and asking for their services. I am assuming that you have not yet done this. They now have some very harsh penalties they can impose for non-payment of child support, such as taking away his driver's license.

Good luck.
