Legal Question in Family Law in Minnesota

I am recently divorced and in my divorce decree I agreed to giving my ex my tax refund for 2011 and 2012 to help offset what he pays in taxes. However in the decree it does not say anything about the amount of $ to be paid towards tax preparation, in which I have a $300 bill. Im thinking I should be able to subtract the $300 to pay for my tax prep and the remainder goea to my ex, he is however saying no way, that is not included in the decree. Help???

Hello. I suggest you focus on the wording of the court Order. Since you take issue, certainly I recommend that you have a private attorney assist and advise you. Often, in my experience, a person with an issue such as you stated, will actually have multiple issues and areas of concern for which the attorney will provide legal counsel and practical advice. I recommend you telephone several attorneys in choosing, because you need to feel a sense of great trust and confidence. I also recommend that you choose an older and more experienced attorney. If your divorce decree does not state there is an offset for tax preparation, then there is no offset for tax preparation. However, if it is a joint return, it is fair for each party to pay one half of any costs for the tax preparation.
