is it my responsibility

is it my responsibility to make sure that a jointly owned car that my spouse has in possession,is properly insured during our divorce proceedings?We still have a loan on it.

As long as the car is in your name, you are required to carry insurance. It's your spouse's responsibility too, but I sense that you feel you can't count on her.

If you had a temporary order saying that she has use of the car and that she is to provide insurance, you would be in better shape - but that does not provide protection from third parties.

Best solution is to transfer the car to her now just to get off the hook for the insurance. This might mess up your settlement negotiations, however. Next best solution: get the divorce settled as quickly as possible and make sure the car is transferred as part of the settlement.
