Legal Question in Family Law in Minnesota

Situation: Unmarried woman found out she was pregnant after the potential father died in MN. The coroner collected DNA samples of the deceased. The next of kin will not respond to requests for the coroner to release the decedent's DNA for genetic testing of the potential child. What does this mother need to do and about how much will it cost to determine if the deceased is the father of her child?

Mother can apply for child support services through the county where she resides and then the county can address the adjudication. ($25 application fee) Mother should check with the county, however, on whether the county has the time and resources to do this (due to current economic conditions, some counties might not undertake this case). Another option will be to retain an attorney to commence a paternity action. If the county can assist the mother, it will only cost her $25 to apply. If she uses the services of a private attorney, it is hard to predict how much it will cost since it will depend upon the next of kin and how cooperative they are. Most attorneys give free half hour consultations and will let mother know how much their retainer will be.
