if my wife starts a daycare in our home does she have more legal rights to the home because she has her business there?

No, having a home business would not give her any more rights to habitation than you. The court, however, may give some weight to her business in deciding who to award the house to when everything is said and done. This probably would not show up in the findings of facts.
