Legal Question in Immigration Law in Minnesota

Deportation

I have been married to a U.S Citizen for almost 3years. We did not have the money to file the paper work right way. We also have a daughter together. I filed my paper work about 2mths ago. Before doing that i filed a form that i had to get a hold of my I94 from Homeland security. My passport was stoled years ago. I did get a copy of my I94 and then filed my paperwork. Six months later I recived a Action of Removal and I just got a letter with a set court date. I have already done my figure printing and waiting for my work permit and SS card. The form that they have send me is also in my maidian name not use if they know that I am married and have filed my papper work. I am not sure what can happen here. Can you please give me some advise on what I should do. And what can happen. I asked this question awhile ago.

Now I have a new one. I do not have the money to get an attorney. Can someone point me to the right direction I need some help? I have been doing research and saw that I have a lot of points why I should stay. I have been here for almost 9years. I have strong ties in my community I help out a lot at my home church. I am not an American but I tell you I surly feel like one. Please someone please tell me who can help?

Dear Inquirer:

If you are in removal proceedings, you may still be eligible to file for adjustment of status to green card as relief from deportation. You will need to file your visa petition with the USCIS and, based on that, apply for the green card before the immigration judge.

You need to hire a qualified immigration attorney. You cannot miss any single court hearing in Immigration court or you will be ordered removed (deported) in your absence.

You can be ordered deported whether you are married to a USA citizen or not, unless your removal proceedings are terminated.

This situation cannot be helped through free internet forums. If you have no money, the immigration court will NOT appoint a free lawyer to you. However, you may look for some Free Legal Help/Aid organizations available in your community.
