Deposit

I agreed to rent an apartment and paid a application fee and a $800. deposit to hold apartment. My wife came back from a trip and I wanted to show it to her. She was not happy with my decision and does not want to rent it. The landlord has not returned my deposit claiming the payment makes it a binding contract. But I have not signed a lease does this payment infact create a contract and can the leesor keep this deposit or am I entitled to have the full deposit returned? He says he had turned down other potential renters and that the deposit bonded an agreement for me to lease the house.

I would have to take a look at the application and any other written documentation before answering this question. It may be very effective for an attorney to write a letter to the landlord asking him to return the $800 deposit. Feel free to contact me to discuss.
