Legal Question in Product Liability in Minnesota

'' 2003 kia rio with a bad engine''

I have owned a 2003 kia for 8 months. The oil plug came out

with no for warning and the engine is no good. The dealership says they are not liable to talk to the oil change place. The oil change place says they are not liable because their warrantied service is for 3 months or 3,000 miles. Can i achieve any legal success by pursuing either to cover the $4,000.00 for a new motor?

Thank you

It sounds as if you have a claim against the oil change company if they failed to put the plug back on or put it on incorrectly so that it allowed oil to leak. Their negligence is failing to properly secure the plug would not normally be covered by their "warranty".

If you can show what happened you probably are best to bring a claim in small claims court for the value of a new engine.

Our office is not representing you on this matter and I would urge you to contact an attorney near you to discuss this matter more fully. You should act promptly as there are limitations on the period of time you have to bring a claim.

Good luck.
