Legal Question in Real Estate Law in Minnesota

abandonment of personal property

Greetings:

I purshased a home on 11/25/2003 and was informed that the property had a rented water softner. In late January I was approached by the water softning company for continuation of service, which I declined. Now they want their water softner back. I was told by a real estate agent that, since the previous owner informed the water softning company of the transfer of realestate and the company failed to remove the equipment it is therefor abandoned property. Is this true? What Minnesota statues would support this?

Thank you for your time,

Andy

Re: abandonment of personal property

This sounds like wishful thinking on the part of your realtor. If many months had gone by without you hearing from Culligan or whoever, then yes I would call it abandoned property. But the interval between late November and late January seems reasonable to me and I would not call it abandonment.
