Legal Question in Real Estate Law in Minnesota

legal use of easement on private property

My family owns a cabin in northern minnesota. To access this property, which our family has owned for about 50 years we have a one mile long easement road. We would like to know what our rights are concerning this road, for example can we ride a 4-wheeler on this road to and from the county road? Who is responsible for the upkeep of this road? If it is us, can we ask for monetary help from the owners who also happen to use this road for farming.Any help would be greatly appreciated. Also any information about where we could find this information would be a great help. Thanks for your time.

Re: legal use of easement on private property

We start by examining your record title to the cabin to determine how the easement was aquired. If it was aquired through a recorded document, that may have language concerning the use and maintenance of the easement. Then it's a matter of interpreting that language with consideration for common and statutory law.
