Legal Question in Criminal Law in Mississippi

Bail Agent & Bail Enforcement Laws of Mississippi

On this date my agent wrote a felony bail bond for a client that was on an existing felony bond with another company. The agent and or bail enforcement agent for the first bond was standing outside the jail awaiting the release of this client and grabbed the client from my agents custody and handcuffed him. My agent asked the agent what was he doing and told him she needed to get some information and signature from the client. The agent replied to my agent ''I don't have time for you-get out of my way- he is going with me.'' I called the company and asked why did their agent grab our client. I was told ''he owes us money and we are revoking his bond.'' Two hours later the agent called me back and said '' I will bring the client to your office and drop him off- he is at my office.'' I asked - are you not revoking his bond?- she said ''no'' Now three hours have passed and still no client. Is this agent within his legal rights of taking our client away from us and preventing us of our rights just because the client owed him money when he did not revoke the clients bond at all?

This response is not confidential and is not based on any particularized research. It is based on my general experience, and only the limited facts in your email. No attorney-client relationship is formed.

You each had equal legal custody of the person. However, you had physical custody as well at the time, and the other bonding company had no right to take the accused from your legal custody without a court order. It seems that the agent for the other bonding company interferred with your contractual rights and committed an unlawful simple battery on your agent.
