Legal Question in Criminal Law in Mississippi

Disorderly Conduct

An officer pulled into my driveway and said there had been an incident involving someone who had lived in my house .I told him that person no longer resided in my home ,and as I had just arrived 15 min.before him I had no idea what was going on.I answered the few questions I had any knowledge of.And told him if I thought of any thing else I would contact him.I turned to go into my house and he said don't you turn your back on me .Then he wanted to see my ID.I told him he wasn't being a very nice public servant as he had run my tags and knew who I was, and was harassing me .So he arrested me.No maranda. My neighbor asked if he would uncuff me if she got my ID.,but she couldn' t find it .I was not allowed to lock my house ,get my shoes or anything.they didn't even put me on the books yet I paid a bondsman 150.00.I had done nothing.I told him what I did know .After that in my eye's he was trespassing. What happend to the people shall be safe and secure in there homes? Is the constitution just a piece of paper?

Re: Disorderly Conduct

If it was outrageous conduct or a pattern of intentional conduct, there would be a Constitutional claim for violation of due process. Otherwise, you may have a claim for false arrest. Moreover, you have a basis for making a complaint to the police department for misconduct. You should get a detailed written statement from your neighbor and anybody else who witnessed the matter if you intend to pursue it.
