Legal Question in Family Law in Mississippi

Family law/ Divorce

I left my husband 4 years ago due to his drug abuse. 6 months later he went to jail and is still incarcerated. I want a divorce but have been told that if he refuses to sign then I have to sue him and it will cost alot of money. I've been taking care of our 2 children on my own and can not afford any more. What can I do?

Re: Family law/ Divorce

You will have to sue him. Being sent to a penitentiary is a ground for divorce for which there is no defense. It should not cost a lot more than a no-fault. In fact it can be quicker as there is a 30 day wait rather than 60 days. He can waive process and you can get your divorce just a few days later. Go for it.
