Legal Question in Family Law in Mississippi

father using drugs

I have a three year old child that I share custody with. My child's father has not paid child support for several months and he has gone through a lot of jobs lately. He used drugs years before we were together. Several of his close family members have called me to tell me they are concerned about my son being with his father because he is using drugs heavily. Can I just stop letting my son go to his father's house? Can I go to court and tell just what I have heard or do I have to have some sort of proof that he is using drugs? If so, what kind of proof do I need?

Re: father using drugs

You can ask the court for modification of child visitation and to order the father to undergo a hair folicle drug screen test. Also have you son undergo the same test. Pending the final hearing you can ask the court to temporarily suspend visitation. Also, you can ask your informants to report the father to local police. They may be able to make an anonymous report if necessary.
