Do I need a lawyer?

I have a 2 year old son that lives with me and his Dad and I were never married. His dad is now living with his mother and he is on house-arrest. He is a convicted felon and he has a lot of anger problems. I gave him the ultimatum of going to get help for his problems or not seeing his son. He chose not to get help. Well, recently I signed an affidavit against him for harrassment. He has not seen my son in almost 3 months and has not given me a penny for my son either. I went to court the other day thinking that this would settle the whole ordeal but little did I know...He got a lawyer and they continued the case. I don't have a lawyer and don't really have money to pay for one since I am taking care of my son by myself. My question is: IF I was to get a lawyer, Is there anyway for me to try and get sole custody of my son and to deal with this affidavit thing that is happening right now together? I've got phone records showing him calling me 30 times a day and pictures of where he has put bruises on me and punched a hole through out bedroom door at where we used to live. I need some advice more than ever! I am scared to go anywhere with my son because I'm afraid that his Dad is going to run up to me and take him....Please help!

I�m assuming this �affidavit thing� is a criminal charge or a request for a restraining order. If this is criminal in nature, the prosecutor will take care of this. As for custody, since you were not married, he has few rights other than an obligation for support. If you can�t afford an attorney, I would suggest you speak to your county Department of Human Services (DHS) to help you establish paternity.
