Legal Question in Family Law in Mississippi

restraining order

I need to know what I can do.My husband has been arrested twice and is now on probation ,all for domestic violence.The problem is he is still verbally abusive and around my two small sons here also. Our apartment is in his name only and I want to see if it is possible to have him removed from here.Our youngest son is 2 months and my other son is 5.I have no place to go if he stays here,and we are forced to leave because of his behavior.Can I file for seperation or a restraining order and be allowed to remain in the apartment ,even though it is in his name?I am tired of his verbal abuse and want him out!

You need to talk to your landlord and see what his/her take on the situation is. If he/she is simpathetic to your cause, that would be a big help because then you could file for temporary relief and a restraining order at the same time. This would allow you to keep the apartment, him to leave, you to get support and protection.
