Can you please tell me what the law states about allowing cattle to roam free (at all times) on a public road. And also if the county has maintained this road for over 40 years, is this considered to be a public road.

Depending upon the statutes in a particular state, a state may be open range or close range. Mississippi for a long time was an open range state but it may be close range now with suburbs encroaching more and more into the countryside. The County Department of Public Works should be able to tell you whether the road you refer to has been dedicated by the county as a public road.
