Legal Question in Insurance Law in Mississippi

money for down payment

I was involved in an automobile wreck. I was going straight and the car that hit me was turning left. My insurance has totalled my car. I heard that I am entiltled to a 1000 dollars extra for a down payment on a new vehicle. Is this true? Shouldn't the insurance the other person has pay for my car and other expenses? Should I contact them or find a lawyer? I am still hurting and have a doctor's visit this week. Who pays for my medical expenses and loss of wages? What about the loss of the vehicle?

There is no Mississippi law that entitles you to $1,000.00 for a down payment. If your insurance policy provides that for you, good, but that depends on what your insurance policy says. I have never seen that in an insurance policy. However, Mississippi law does provide that you are entitled to damages for the daily loss of use of your vehicle. You are also entitled to damages for your medical expenses, pain & suffering, and any other sustained damages. I recommend that you find an attorney in your area who is skilled in automobile accidents. There is oftentimes more to an automobile accident than what meets the eye.
