Farm equipment liable

I can't speak for the law in your state. But generally, based on the law in my state, farm equipment doesn't have any special privileges. The highway code very likely requires they have special warning signs for being slow moving.

Also, a fundamental concept in traffic rules is that nobody ever "has" the right of way; instead, traffic codes usually state when a driver must yield. Every driver, of every type of equipment on the road, must always use reasonable care to avoid injuring another person.

So a farm equipment operator can be held liable if at fault. That depends on the exact facts and the controlling law which applies, based on those facts.

The above does not constitute legal opinion and is offered for the purposes of discussion only. The law differs in every jurisdiction, andyou should not rely on any opinion except that of an attorney you have retained, who has a professional duty to advise you after being fullyinformed of all the pertinent facts and who is familiar with the applicable law.
