I was divorced in 1999 and my ex-wife was awarded our mobile home in the settlement. She refuses to refinance the home so that my name is off of it. She is constantly behind in her payments and I am getting calls from the creditor and am being reported to credit bureaus as a reslut of her actions. What can I do to stop the creditor from calling me and to get them to stop reporting me to credit reporting agencies?

If you signed the note with her, unfortunately, whether you like it or not, you're bound to pay if she doesn't. So obviously, it behooves you to get your name off the loan.

The best way to do this is to file a motion to modify the decree and ask the Court to order the ex-spouse to either indemnify you and hold you harmless (by awarding you maintenance in gross for the amount of the indebtedness with that being executable only on her default) or by ordering her to refinance the mobile home at issue.
