Legal Question in Credit and Debt Law in Missouri

I was told that a lady got rid of her credit card debt by hiring an attorney and he took the credit card companies to court. The debt was taken away because it was an unsecured debt. Exactly what is this process, how does this process work and is it a better route than filing bankruptcy?

I do no tknow for sure what route the attorney took, but it sounds like he got a declaratory judgment. It can make some debts uncollectable, in at least that juriusdiction. But, it can act as a forum for the credit card company to obtain a judgmetn agaisnt you for the debt, without having to pay the filing fee. It would normally be less expensive than bankruptcy, and possibly not have nearly as detrimental effect on your credit rating.
