Legal Question in Criminal Law in Missouri

Expunging juvenile record

My son will turn 21 this month. When he was 19 he got a DWI. and was put on 2 years probation which will also end this month. We were under the impression that since he was a minor the DWI would drop off his record. Does he need to have his juvenile record expunged and if so, how does he go about doing this?

Re: Expunging juvenile record

If the "juvenile record" you are referring to is the DWI, then you have a misunderstanding of the law. Your son was not a juvenile at the age of nineteen. Also, if he received the DWI and received two years probation as you say, then he probably waas charged in either state court, a county court or some municipal court. If he received a suspended impositon of sentence on the DWI, then there will be no record of any conviction. There will always be an arrest record. If he wants to try for an expungement some courts actually provide forms for the individual to try to do it himself. If you asked me to do it, I would have to do some legal research to see whether there is any current statutory authority for an expungement.
